Deep dives
Mediation Process Overview
Mediation is a process of dispute resolution facilitated by a neutral third party mediator to negotiate and resolve issues in cases, commonly used in family law matters. It provides an opportunity to settle outstanding issues, with courts often mandating it before hearings. Parties present at mediation sessions typically include both individuals involved, their attorneys if represented, possibly additional parties like guardians, financial experts, and the mediator.
Role of Mediator
The mediator acts as a neutral party with no connection to the case, aiming to facilitate settlement and find common ground on contested issues. They refrain from providing legal advice and focus solely on helping parties reach agreements in family law matters.
Binding Agreements and Enforceability
If an attorney is present during mediation and parties sign final settlement documents, the agreement is usually deemed binding. However, without legal representation, individuals may have a few days to review and withdraw consent. Bullet point agreements, even if partial, can still be enforceable when reached in mediation.
Duration and Flexibility of Mediation
Mediation sessions can vary in length based on unresolved issues, lasting anywhere from six to ten hours or extending to late hours if fruitful progress is made. Flexibility is key, with parties advised to clear their schedules and stay until agreements are reached, potentially avoiding costly court trials.
In this show, Todd and Leh are joined by Lisa Marie Chambers. Lisa Marie breaks down what mediation is and how to use it to settle your case. Mediation is a very positive, cost effective way to settle any litigation, but it is especially effective to settle a divorce of child custody dispute.
