The desperation of Donald Trump and many of his co-conspirators is showing. Attorney/RICO defendant Kenneth Chesebro has filed a motion asking the judge to dismiss his case claiming he was "justified" in giving the Trump campaign legal advice about the fake elector scheme. Also, Mark Meadows has filed an emergency appeal after a judge's denial of his motion to transfer his case from Georgia state court to federal court. After hearing extensive evidence of election crimes from Donald Trump and his many criminal associates, the Georgia state special grand jury recommended indicting 40 individuals. However, the RICO indictment that was issued in Georgia charges only 19 of them with crimes. Glenn says there are many different ways this could play out in court. A federal judge just ruled that Mark Meadows failed to even make the minimal showing that his Georgia RICO prosecution should be transferred from state court to federal court. This finding is likely to be fatal to any effort Trump may have mounted to try to move HIS case to federal court. Glenn says this ruling means Meadows, Trump and their other criminal associates and co-conspirators will be tried in Georgia state court, and the trial will be televised and live-streamed for all to see. Then, the Georgia state special grand jury that hears the evidence in the Georgia state elections crimes investigation recommended that Sen. Then he talks about the head of the Proud Boys, Enrique Tarrio, who was sentenced to 22 years in prison. Glenn points out that Trump appointed Judge Timothy Kelly misspoke when he said Tarrio was the "ultimate organizer and ultimate leader" of what happened on Jan. 6. No, Trump is the ultimate organizer and leader of the insurrection. Next, constitutional scholars are coming together in the opinion that Trump is already disqualified from holding office again, as a result of section 3 of the 14th Amendment. Glenn discusses how this might play out in court. Then finally, Jim Jordan is now obstructing Trump's Georgia state RICO prosecution. Constitutional scholars, both Republican and Democrat, are unifying behind one position: section 3 of the 14 Amendment disqualifies Donald Trump from holding any federal office in the future, including the presidency, because he engaged in an insurrection against the United States, after taking an oath to support the Constitution. Scholars say the constitutional disqualification is self-executing, requiring no act of Congress, no act of any state legislature, and no court proceeding, civil or criminal. Glenn breaks down, in layman's terms, the arguments made in a lengthy law review article authored by two conservative constitutional law professors, William Baude and Michael Stokes Paulsen. Then, more and more of Donald Trump's aides, associates, and underlings are beginning to point the criminal finger at Donald Trump. As Politico reported, " Trump's co-defendants are already starting to turn against him." Donald Trump has four serious felony prosecutions pending against him. Yet, he continues to say and post things that put prosecutors, judges, witnesses and jurors in harm's way. The legal test for whether someone should be detained pending trial is as follows: is there clear and convincing evidence that the defendant is either a flight risk or is a danger to the community? The evidence clearly establishes that Trump is a danger to the community. Glenn says he hopes that the judges soon apply the law and neutralize the ongoing, demonstrated danger that is Donald Trump. DC federal court judge Beryl Howell has ruled that Rudy Giuliani is liable for lying about and defaming Georgia election workers Shaye Moss and her mother Ruby Freeman. The lawsuit brought by Moss and Freeman will now move on to the damages phase for a jury to determine how much Giuliani will have to pay the two woman in compensatory and punitive damages.
