Rudy Giuliani told vile, racist, dangerous, and defamatory lies about Georgia state election workers Shaye Moss and Ruby Freeman. Staggeringly, even after Giuliani admitted, in a court filing in the case, that he lied and defamed the two women, he went on to lie and defame them 20 more times, as the plaintiffs' lawyer highlighted to the jury during closing arguments. Special Counsel Jack Smith has filed an unusual request - asking the Supreme Court to swiftly take up the issue of Donald Trump's claim that he can't be prosecuted for the crimes he committed while president. Smith wants to leapfrog the case over the DC federal circuit court of appeals and have the Supreme Court resolve the issue quickly so the case can proceed to trial on schedule by March 4th. (This is assuming the court rejects Trump's claim that he is above the law). Donald Trump and his lawyers incessantly claimed that Donald Trump would take the stand in his own defense at his New York fraud trial. The Colorado Supreme Court has heard oral arguments on whether the 14th Amendment's disqualification clause means Trump will have his name taken off the presidential ballot. Glenn reviews some of the arguments made by the parties and highlights some of the absurd positions taken by Trump's lawyers. For example: they are claiming that the January 6th attack on the US Capitol wasn't really an insurrection because "it only lasted three hours" or because "it only targeted one building." Then, the DC federal circuit court of appeals largely affirmed the gag order Judge Tanya Chutkan imposed on Donald Trump, trying to address his dangerous speech and posts. This time in our longform weekend podcast - Glenn runs down the legal stories of the week. First, Donald Trump said during Sean Hannity's interview - if he's elected - he'll be a dictator on day one. Even worse, he just put something in a new court filing in his criminal case in DC that indicates he also intends to act like a dictator in his criminal case - deciding legal issues himself rather than waiting for or abiding by legal issues as decided by Judge Tanya Chutkan. According to Glenn - this is a new level of danger Trump is injecting into the mix. Then, Judge Chutkan rules that presidents are not kings, and therefore are NOT absolutely immune from prosecution for their crimes. Glenn says her work is masterful and inspirational. Next, we now know that former Vice President Mike Pence is on the prosecution's witness list in Trump's Georgia state RICO case. Glenn discusses how Mike Pence's testimony will bring the criminal heat to Trump. Then finally, a new Jack Smith court filing reveals how one of Trump's "campaign employees/co-conspirators" attempted to start a "riot" at the Detroit, Michigan, vote-counting center on Nov. 4, 2020, once he saw the count was trending for Joe Biden. New court filing reveals evidence of a Trump co-conspirator inciting a riot in Detroit during the election.
