DC federal district court Judge Tanya Chutkan has imposed a gag order prohibiting Donald Trump from saying or posting anything about the witnesses, prosecutors, or court staff. DC federal court Judge Tanya Chutkan imposed a gag order on Donald Trump to prohibit him from threatening, intimidating, or harassing witnesses, court staff, and prosecutors. As all of the world saw on January 6th, 2021; Donald Trump inspired, incited, and engaged in an insurrection. Moreover, Trump continues to give aid and comfort to insurrectionists by (among other things) promising to pardon those who attacked the US Capitol if he is re-elected. Now, a Colorado judge has ruled that a lawsuit seeking to disqualify Trump's name from appearing on the presidential ballot in that state can move forward. In our longform weekend podcast - Glenn recounts this week's Trump news. First, District Attorney Fani Willis tells Representative Jim Jordan, in no uncertain terms, that he is abusing his authority by interfering in her RICO prosecution of Donald Trump. Glenn says unfortunately, this abuse by Jordan and other Trump insurrectionists in Congress will continue until the Department of Justice indicts them for their crimes. Then, Special Counsel Jack Smith has filed a motion urging DC federal court Judge Tanya Chutkan to adopt jury procedures to protect jurors from Donald Trump. And on Monday, October 16, Judge Chutkan will take up Smith's request for a gag order on Trump to protect witnesses and others from Trump's continued threatening speech and posts. Glenn says he will be there in the courtroom on Monday to report what happens. And, after spending a few days attending his fraud trial in New York, Trump apparently grew tired of it and stopped attending. Special Counsel Jack Smith has filed a motion in Donald Trump's DC prosecution seeking to protect jurors from Trump's dangerous speech and social media posts. The "Motion for Fair and Protective Jury Procedures" seeks to have the court use a juror questionnaire to streamline the jury selection process in the DC case, and seeks to prohibit Trump and his lawyers from publicly disclosing the identities of - or attempt to communicate with - prospective jurors in any way. Notably in the motion, Smith lays out Trump's "attack," via a social media post, on New York Judge Engoron's law clerk and the ensuing gag order imposed by the judge. The New York Times reported: "Trump said to have revealed nuclear submarine secrets to Australian businessman." Defendant Trump is on pretrial release in four felony cases: two state and two federal. If the law was applied as intended, Trump would be in a jail cell, detained pending trial. But he's not. Instead, he's ruminating about perhaps being the next Speaker of the House of Representative. Glenn Asks "What's wrong with this picture?" The answer - "Everything". Then, as the January 6th select House committee's report has found: Jim Jordan was "a significant player in Trump's efforts" to overturn the 2020 presidential election. A new piece by Sirius XM host Dean Obeidallah highlights some of the key findings of the Jan. 6th committee's report about Jordan's complicity in Trump's insurrection. New York state court Judge Arthur Engoron PROMTLY issued a gag order when Trump posted something endangering the judge's law clerk. Glenn says that's undoubtedly a good and necessary step - but what does it say about the fairness of our criminal justice system and the equal application of our laws that NO judge has seen fit to impose a gag order on Trump to stop him from endangering the witnesses who will testify against him at his many criminal trials? 2. Donald Trump endangers our national security in ways that can still shock and outrage us. ABC news broke the story that Trump divulged nuclear submarine capabilities to a foreign national while palling around at Mar-a-Lago. Glenn asks - will the criminal justice system ever step up, deploy the law as it is intended to be deployed, and detain Trump pending trial? Or will he continue to be allowed to endanger our national security with total impunity?3. Trump lawyers have filed a blizzard of motions in his criminal cases trying to get those cases dismissed. Glenn explains the reasons why those motions will be denied. 4. Things are progressing nicely in Trump's Georgia state RICO case, with one co-conspirator having already flipped and lots of plea offers being extended to other potential flippers. According to Glenn - this is bad news for Trump.5. Finally, Trump sat in for a few days of his civil business fraud trial in New York. He even threatened to testify in that case. Donald Trump's civil fraud trial in New York has begun, and he predictably started the day with dangerous rhetoric directed at the Judge and New York Attorney General Letitia James. Specifically, Trump said people should "go after the Attorney General." On a lighter note, one of Trump's attorney's, Christopher Kise (who was previously sanctioned by the judge for his conduct in the pretrial litigation in this case), said in his opening statement that there is no such thing as an "objective valuation" for property. Glenn says - perhaps not, but there is rampant, transparent and obvious fraud, as reflected in Trump's absurd and inconsistent valuations of his properties. Then Judge Arthur Engoron - in a long overdue development, FINALLY placed a limited restriction on Trump's speech and posts. He was angry after Trump posted a picture of his law clerk taken with Senator Chuck Schumer. Trump was mocking the picture claiming the law clerk was "Schumer's girlfriend" and insisting that his fraud case should therefore be dismissed.
