In a sweeping ruling and stern condemnation of Trump's violation of both the federal law AND the Constitution, a federal judge in California ruled that Trump must relinquish control of the California National Guard and return control to California Governor Gavin Newsom. However, the appeals court has issued a brief stay/pause on the ruling.In ruling against Trump, Judge Charles Breyer wrote: "At this early stage of the proceedings, the Court must determine whether the President followed the congressionally mandated procedure for his actions. He did not. His actions were illegal both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution. Attorney General Pam Bondi and her Department of Justice lawyers said repeatedly that it was impossible to facilitate Abrego Garcia's return to the United States. Then, lo and behold, they arranged for Abrego Garcia's return to the US and waived around a two-count criminal indictment claiming that he's been involved in a criminal conspiracy from 2016 through 2025. In other words, if it's true, the first Trump DOJ let Garcia run a dangerous criminal conspiracy inside the United States with impunity during the entirety of Trump's first term. And, Garcia was in court in 2019 and the judge issued an immigration order that allowed him to reside in the United States to escape gang violence. The Trump administration has been peddling to the American people that its deportation effort would focus on immigrants who had been convicted of crimes. So it turns out that Donald Trump, Attorney General Pam Bondi, and the Department of Justice lawyers were lying all along when they claimed it's impossible to return to the United States someone they wrongfully deported, because that person was in a sovereign nation and the US had no power or authority to facilitate the person's return. For the first time, the Trump administration HAS facilitated the return of a Guatemalan migrant that they had wrongfully deported to Mexico. A federal judge in Massachusetts ordered the Trump administration to "take all immediate steps" to return the man. The administration complied with that order and now the man is once again back in the US.
