Justene Hill Edwards is the author of Unfree Markets: The Slaves’ Economy and the Rise of Capitalism in South Carolina (Columbia University Press, 2021). Unfree Markets focuses in on an area of slavery’s history that has seldom been explore: the economic lives of enslaved people, and its meaning for them, enslavers, non-enslavers, and the institution of slavery itself. Hill Edwards explores how the complicated history of the slaves’ economy from the colonial period to the Civil War, showing the relationship between it and the development of capitalism in the nation. Matthew Clair, "Privilege and Punishment: How Race and Class Matter in Criminal Court" (Princeton UP, 2020)
Privilege and Punishment: How Race and Class Matter in Criminal Court (Princeton UP, 2020) by Matthew Clair is a powerful ethnographic study of the experiences and perspectives of criminal defendants. While many studies have demonstrated the existence of race and class disparities in the criminal justice system, Clair conducted a rare and compelling study that puts heart and emotion into these disparities. As he argues and shows, not only should we care about quantitative inequalities in criminal justice, but "[w]e should [also] be concerned about differences in the quality of the court experience" for so many defendants.Clair did extensive interviews with and observed criminal defendants, defense lawyers, judges, police officers, and others interact with each other in the Boston court system. What he shows is a system that operates differently for people of privilege compared to people without. While many criminal defendants face struggles of alienation from societal structures, the underprivileged often resort to crime out of necessity, whereas privileged defendants were more likely to enter the system because of pleasure-seeking or to avoid pain. Once in courtrooms, underprivileged defendants, especially racial minorities, develop profound mistrust of their court-appointed attorneys. These defendants face, and have often repeatedly been represented by overworked lawyers who often refuse to listen or to develop relationships of trust with their clients, which led many of these defendants to "withdraw," as Clair coins it, from the attorney-client relationship. Some resisted the lawyer or the court: complaining openly about the lack of diligence, asking the court to appoint new counsel, or taking it upon themselves (often with group support) to learn the law and make the arguments their lawyers refused to make. Others developed what Clair calls an attitude of resignation, recognizing the futility of their situation, and essentially giving up the fight. The experience is fundamentally different for privileged defendants. These defendants often have broad social circles that include the police or lawyers. Because of those connections, they are able to obtain counsel of their choice. The payment of fees engenders trust in the relationship. These defendants defer to their lawyers, trust their judgment, and feel genuinely satisfied with the representation.Clair argues that courts punish those defendants who withdraw from their lawyers and reward those who defer to them. He calls on lawyers to develop more trusting relationships with their clients and to work toward a more holistic style of defense that considers more than just the legal issues in the case. He encourages courts to allow defendants to choose their court-appointed attorney and to encourage a more participatory legal system in which defendants are not punished for expressing dissatisfaction with their lawyer. Clair's study is replete with compelling and personal examples. The narrative is what makes this study especially moving. Clair gives voice to those who repeatedly tried, but failed to get their lawyers and courts to listen. Because of Clair's work, we can now hear them.Samuel P. Moya Bailey, "Misogynoir Transformed: Black Women’s Digital Resistance" (NYU Press, 2021)
Where racism and sexism meet—an understanding of anti-Black misogyny. When Moya Bailey first coined the term misogynoir, she defined it as the ways anti-Black and misogynistic representation shape broader ideas about Black women, particularly in visual culture and digital spaces. She had no idea that the term would go viral, touching a cultural nerve and quickly entering into the lexicon. Misogynoir now has its own Wikipedia page and hashtag, and has been featured on Comedy Central’s The Daily Show and CNN’s Cuomo Prime Time. In Misogynoir Transformed: Black Women’s Digital Resistance (NYU Press, 2021), Bailey delves into her groundbreaking concept, highlighting Black women’s digital resistance to anti-Black misogyny on YouTube, Facebook, Tumblr, and other platforms. At a time when Black women are depicted as more ugly, deficient, hypersexual, and unhealthy than their non-Black counterparts, Bailey explores how Black women have bravely used social-media platforms to confront misogynoir in a number of courageous—and, most importantly, effective—ways. Focusing on queer and trans Black women, she shows us the importance of carving out digital spaces, where communities are built around queer Black webshows and hashtags like #GirlsLikeUs. Bailey shows how Black women actively reimagine the world by engaging in powerful forms of digital resistance at a time when anti-Black misogyny is thriving on social media. John Murillo III, "Impossible Stories: On the Space and Time of Black Destructive Creation" (Ohio State UP, 2021)
In Impossible Stories: On the Space and Time of Black Destructive Creation (Ohio State UP, 2021), John Murillo offers bold new readings of recent and canonical Black creative works within an Afro-pessimistic framework to excavate how time, space, and blackness intersect—or, rather, crash. Building on Michelle Wright’s ideas about dislocation from time and space as constitutive to being Black in America, as well as on W. E. B. DuBois’s theories of temporalization, he reconsiders the connections between physical phenomena and principles, literature, history, and the fragmented nature of Black time and space.Taking as his lens the fragment—fragmented bodies, fragments of memories, fragments of texts—Murillo theorizes new directions for Black identity and cultural production. Combining a critical engagement of physics and metaphysics with innovative readings of Gayl Jones’s Corregidora, Octavia Butler’s Kindred, Toni Morrison’s Beloved, Kiese Laymon’s Long Division, Dionne Brand’s A Map to the Door of No Return, and Paul Beatty’s The Sellout, he offers new ways to think about anti-Black racism and practice Black creativity. Ultimately, in his equally creative and analytical responses to depictions of Black people left out of history and barred from spaces, Murillo argues that through Afro-pessimism, Black people can fight the anti-Black cosmos. Jordana M. Saggese, "The Jean-Michel Basquiat Reader" (U California Press, 2021)
In The Jean-Michel Basquiat Reader (University of California Press, 2021), Jordana Moore Saggese provides the first comprehensive sourcebook on the artist, closing gaps that have until now limited the sustained study and definitive archiving of his work and its impact. Jean-Michel Basquiat (1960–1988) burst onto the art scene in the summer of 1980 as one of approximately one hundred artists exhibiting at the 1980 Times Square Show in New York City. By 1982, at the age of twenty-one, Basquiat had solo exhibitions in galleries in Italy, New York, and Los Angeles. Basquiat's artistic career followed the rapid trajectory of Wall Street, which boomed from 1983 to 1987. In the span of just a few years, this Black boy from Brooklyn had become one of the most famous American artists of the 1980s.Eight years after his first exhibition, Basquiat was dead, but his popularity has only grown. Um retrato original da Bahia no século XIX, num livro cheio de movimento e vozes, sobretudo da gente negra. Em Ganhadores: A Greve Negra de 1857 na Bahia (Companhia das Letras, 2019), o historiador João José Reis reconstitui a história dos negros de ganho, ou ganhadores, protagonistas de uma insólita greve que paralisou o transporte na capital baiana durante vários dias em 1857. Esses trabalhadores escravizados, libertos ou livres, todos africanos ou seus descendentes, se organizavam em grupos de trabalho e percorriam a cidade de cima a baixo fazendo todo tipo de serviço, sobretudo o carrego de pessoas e objetos ou a venda de alimentos e outras mercadorias. Em 1857, porém, a Câmara Municipal baixou uma postura impondo-lhes medidas que combinavam arrocho fiscal e controle policial. Mas os ganhadores, que já viviam dia e noite sob a vigilância e a violência de autoridades, senhores e "cidadãos de bem", não se deixariam abater. O resultado foi a primeira mobilização grevista no Brasil a paralisar todo um setor vital da economia urbana. Baseado em ampla investigação em documentos escritos, impressos e iconográficos, Ganhadores é um livro revelador e essencial para se compreender a intrincada rede de relações sociais, econômicas e culturais que estruturava a sociedade baiana do século XIX, ancorada na instituição da escravidão e caracterizada por um sistema de controle baseado numa economia de favores e domínio paternalista. Alison M. Parker, "Unceasing Militant: The Life of Mary Church Terrell" (UNC Press, 2020)
Dr. Alison M. Parker’s new book Unceasing Militant: The Life of Mary Church Terrell (University of North Carolina Press, 2020) explores the life of civil rights activist and feminist, Mary Church Terrell. Born into slavery at the end of the Civil War, Terrell (1863-1954) became one of the most prominent activists of her time -- working at the intersection of rights for women and African Americans, anti-colonialism, criminal justice reform, and beyond. Her career stretched from the late nineteenth century to the civil rights movement of the 1950s -- and she was able to see the result of the NAACP’s efforts in Brown v. Board of Education before she died. The first president of the National Association of Colored Women and a founding member of the NAACP, Terrell collaborated closely with other leaders such as Ida B. Wells-Barnett, Booker T. Washington, W. E. B. Du Bois, and Mary McLeod Bethune -- but she also was unafraid to disagree on principle and political strategy. Unceasing Militant, the first full-length academic biography of Terrell, integrates her extraordinary public activism with her romantic, reproductive, parental, economic, and mental health challenges. Understanding what she called the double handicap of sexism and racism, Terrell offered a nuanced and intersectional Black feminist political theory. Terrell insisted upon African American women’s “full humanity and equality” and -- honoring that legacy -- Alison Parker deftly weaves resources of all kinds, including privately held letters and diaries, to provide an account of a woman dedicated to changing the culture and institutions that perpetuated inequality throughout the United States -- but also a breathing, loving, nuanced woman navigating life.Alison M. Parker is Richards Professor of American History and Chair of the History of the Department at the University of Delaware. She researches and teaches at the intersections of gender, race, disability, citizenship and the law in U.S. history. Her earlier works include two books, Articulating Rights: Nineteenth- Century American Women on Race, Reform and the State (Cornell University Press, 2010) and Purifying America: Women, Cultural Reform, and Pro-Censorship Activism, 1873-1933 (Northern Illinois University Press,1997). Kate Dossett, "Radical Black Theatre in the New Deal" (UNC Press, 2020)
Kate Dossett's book Radical Black Theatre in the New Deal (UNC Press, 2020) turns conventional understandings of the Federal Theatre Project on its head. This book shines a light on the extraordinary work done by the FTP's Negro Units, which staged classic plays with Black casts as well as new plays by Black writers like Theodore Ward. These works reflected contemporary conflicts within the Black community, including the competing radicalisms of Garveyism and Marxism, the place of the folk tradition in contemporary Black culture, and the role of woman as leaders in the Black community. David Alan Sklansky, "A Pattern of Violence: How the Law Classifies Crimes and What it Means for Justice" (Harvard UP, 2020)
In the wake of the George Floyd killing, many Americans are engaging in a renewed debate about the role violence and especially police violence, plays in American society. In A Pattern of Violence: How the Law Classifies Crimes and What it Means for Justice (Harvard UP, 2020), David Alan Sklansky, the Stanley Morrison Professor of Law at Stanford Law School, argues that in order to think sensibly about criminal justice, we must consider how we think about violence and the criminal law’s role in shaping our perceptions.Sklansky argues that the criminal law’s definitions of violence have proven “slippery” and have been used in highly inconsistent ways. We talk about offenders as being characterologically violent, but contrastingly talk about the police, gun owners, or free speech activists in nonviolent terms. For example, police officers use “force” to subdue “vicious” criminals. Or they “stop and frisk” suspects instead of violently violating a person’s bodily integrity. While the police have increasingly militarized and have become more insular and reactionary, Sklansky argues that police institutions themselves have also played a role in creating many of the situations in which the police find themselves. Additionally, Sklansky significantly details how our conversations of violence regarding rape and domestic violence, the treatment of juvenile offenders, and free speech and gun rights, suffer from the same inconsistencies, especially as they tend to exaggerate and perpetuate race, gender, and class differences.Sklansky argues that the law has not always drawn consistent boundaries between violent and non-violent offenses. Burglary, while labeled a violent felony, requires no act of interpersonal violence. Assault or battery, on the other hand, are often misdemeanors, though they require physical violence.In addition to thinking inconsistently about violence, most Americans accept and even celebrate forms of societal violence. For example, American prisons, while not officially condoning violence, allow and sometimes encourage violence against prisoners as forms of discipline and retribution. As Sklansky argues, violence in these institutions is often treated as a form of entertainment, a “morbid parody of combat sports.”Sklansky prompts us to confront our overly simplistic definitions and assumptions about violence in the American law. He encourages us to take advantage of an increased awareness of violence and to work toward more just and consistent definitions.Samuel P.
