S1E1 - Can we suspend that Employee?
In this episode of Employment Law Matters, Daniel Barnett looks at when and how you can suspend an employee. Generally, you can suspend as long as you have good reason. Daniel will tell you first about a recent CA decision which said that, and then he will give you five situations where you’ll run into trouble if you suspend. There are five ways in which suspension can lead to a constructive dismissal claim or, indeed, a finding of unfairness if you subsequently make a decision to dismiss.Be sure to subscribe to Employment Law Matters to be notified of new episodes. S1E3 - Top Five SOSR Dismissals
SOSR is like a classic car. It can work well but only in the right conditions. An employer must have a fair reason to dismiss an employee. When other avenues are exhausted, employers can sort to SOSR - which stands for ‘some other substantial reason’. Rather unhelpfully, there is no definition or guidance about its meaning. It must be 'substantial', which can include anything that is not frivolous or insignificant. In this episode of Employment Law Matters, Daniel Barnett talks about the top five SOSR dismissals and why lawyers use that phrase, and looks at in which situations the use of SOSR can prove most useful.Thank you for listening and please leave a review if you found this helpful as it helps others to find the podcast and to keep the project going.🎁 FREE STUFFEmployment law updates – www.danielbarnett.com My YouTube channel - www.youtubelegal.co.ukAsk a question - www.danielbarnett.com/podcastquestion💎 PRODUCTS, MEMBERSHIPS AND COURSESJoin the HR Inner Circle – www.hrinnercircle.co.ukHarassment Pack - https://danielbarnett.com/harassment/HR Platinum Policy Package 2024 – www.polices2024.comThe Virtual Employment Law Academy – www.virtualemploymentlawacademy.comUltimate Employment Law 2024 - https://danielbarnett.com/ultimate2024/Employment Tribunal Compensation course - https://courses.virtualemploymentlawacademy.com/p/employment-tribunalOwn-branded email updates for solicitors - www.employmentlawbulletins.com📚 BOOKSMy books include the Employment Law Handbook, Resolving Grievances and Computer and Social Media Misuse (see all books).🌞 WHO AM I:I'm Daniel Barnett, an employment law and HR barrister.
