217 - 2021 Halloween Special!!!

It is that time of the year again where Leh and Todd talk about what the undead and monsters can do about their family law problems.   To be clear, they both take what they do seriously, but this show is just for fun.  This year, they get a visit from an old favorite, Dracula.  He is having trouble seeing his grandkids because his daughter's family has gone vegan.  Following Dracula, they get a visit from Jaques Th'rippa.  He wants to get a name change because everyone thinks his name is Jack the Ripper.  Leh almost gets blasted by a Predator that is not happy he has been served with a stalking protective order from Arnold Schwarzenegger.  They wrap up the show with a letter from  Frankenstein's monster about how he can get his neck bolts (and other items) back from his ex-wife who took them at the end of the divorce.

214 - Q&A - How do you navigate the divorce process without income?

Leh and Todd came across a question that had many layers.  These layers ran deeper than just the question on the surface. So, they decided to spend most of the show breaking it down.  Here is the question they tackled - How can I file for and successfully navigate the divorce process when I don't currently have income?  I am a full time college student, a senior, my husband is the sole provider. We have two special needs kids that make the situation even trickier. I don’t want him to be able to keep them overnight. He cannot handle their meds and the care they need for more than a few hours. 213 - Knowing The Rules of Evidence so the Judge Rules In Your Favor - Part 2

Leh and Todd finish up their review of the Rules of Evidence.  In particular, they focus on the exceptions to the hearsay rule.  While these rules can get complicated, they take their time to present them in an understandable way.  If you can't survive an 'objection' to your evidence, the Judge won't be able to consider it. 212 - Knowing The Rules of Evidence so the Judge Rules In Your Favor

Leh and Todd take on the rules of evidence.  More specifically, they discuss the exceptions to the hearsay rule.  Hearsay is somewhat straightforward:  It is an out of court statement that goes to the truth of the matter asserted.  What makes this simple rule complicated are all the exceptions to this rule.  In order to properly introduce your evidence in Court, you have to know these rules.  But, Leh and Todd do their best to point out the ones your will most likely encounter in a divorce case and what you need to know about them. 211 - You Want to Avoid Hearing this in Court: "I Object" ... Understanding the Rules of Evidence

Leh and Todd spend some valuable time explaining the rules of evidence, where they come from, why they are there, and how they can seem complicated. 209 - Even More Divorce Strategies that do NOT work!

As a follow up to the last show, Leh and Todd talk about more divorce strategies that do NOT work.  Over the years, they have seen many attempts by people to 'pull a fast one' on them.  They share what they have seen, what does not work and why.  Examples include: Blasting "your story" to others - Social Media; text messages; emails Filing a TPO with unsupported allegations  Contacting your spouse's employer to impact their employment Passively Interfering with Parenting Time Making the kids your “allies” in the coming custody dispute Shutting down and not participating in divorce process Intentionally trying to delay the divorce process Engaging in settlement discussions prematurely I will settle now and fix the terms later I have an attorney, so I am going to let them handle everything I don’t have an attorney & don’t know the system, but I am sure “it will all work out” I will just dismiss the case if things are not going well for me. 208 - Divorce Strategies that do NOT work!

Leh and Todd dive into divorce strategies that do NOT work and explain why they do not work.  While some folks think these things are a good idea, what they often do not realize is that most lawyers have been trained to spot these strategies and how to counter them.   The strategies they know typically fail include: Having no strategy at all Stop working or reduce your income to reduce or eliminate your child support or alimony obligation Choosing to avoid getting a job to increase your support amount Hiding income Hiding assets Moving all the marital assets into only your name Spending more money to increase your 'need' for support Blocking your spouse from financial resources Stopping the payment of marital expenses Locking your spouse out of the house Moving out of the house without an agreement Intentionally making co-habitation difficult on your spouse (so they want to leave) Serving your spouse with divorce paperwork with the intention of embarrassing them If you would like a transcript of this show, you can find it on our website.    If you are enjoying the show, please take a moment to post a positive review about it.  Not sure how?
