Developments in two legal stories: First, Donald Trump's xenophobic henchman Stephen Miller just filed a lawsuit to try to stop the House select Committee from subpoenaing his cell phone records. In the suit, Miller reveals that he's still on his parents' cell phone plan. Miller's legal claims in the suit are frivolous, and his lawsuit is a transparent attempt to to delay matters. In Michigan, a trial is underway against the four men who plotted to kidnap Governor Whitmer. The prosecution's opening statement made clear the the case against the defendants is strong. The attorney for the ringleader, defendant Adam Fox, told the jury in his opening statement that his client is a "hapless, pot-smoking misfit." Only the best people . . . Bill Barr is on his reputation rehabilitation tour. In an interview with the Today Show's Savannah Guthrie, Barr talks about the evidence of Donald Trump's criminal intent in connection with trying to corruptly overturn the results of the 2020 presidential election. There is no question but that the Department of Justice should subpoena Bill Barr to the grand jury in a criminal investigation of Donald Trump. The only legitimate reason DOJ might opt not to subpoena Barr is if federal prosecutors intend to indict Barr and then use him as a cooperating witness. The Daily Beast reported that New York District Attorney Alvin Bragg is refusing to release the resignation letters submitted by the two top prosecutors - Pomerantz and Dunne - who had been assigned to the Trump Organization prosecution and the criminal investigation into Donald Trump himself. Reports are that the letters criticize DA Bragg for his refusal to focus on the case in a timely manner and for his apparent determination to forgo indicting Donald Trump for his crimes. Troublingly, the NY DA's office is refusing to release the letters, claiming that the letters contain "too much information" and could compromise an ongoing investigation. This claim rings hollow. Are we to believe that the the two prosecutors included intimate investigative details in their resignation letters? Or is it far more likely that DA Bragg refuses to release them because the letters are deeply critical of Bragg's neglect of the case? This highlights a fundamental and recurring problem America has encountered in recent years: a lack of accountability for high government officials who have committed crimes coupled with a troubling lack of transparency as to why our law enforcement and prosecutorial agencies are refusing to hold those officials accountable for their crimes. The first criminal trial of a defendant charged with attacking the US Capitol on January 6, 2021, kicked off in DC federal district court on Monday, February 28, 2022. The defendant, Guy Reffitt, is charged with five felonies, including obstructing an official congressional proceeding, carrying a firearm and obstruction justice by threatening his own child in an attempt to prevent them from turning him in to the authorities. Jury selection began with a series of probing questions by the judge in an effort to pick jurors would could be fair and impartial. The Manhattan District Attorney's Officer had been steadily moving forward in its criminal investigation of the Trump Organization and Donald Trump. Indeed, that office indicted both the Trump Organization and Donald Trump's Chief Financial Officer Alan Weisselberg for charges including a 15-year-long criminal scheme to defraud in the first degree. But with the arrival of the newly elected District Attorney Alvin Bragg, the two top prosecutors on the Trump investigation abruptly resigned amid reports that the new DA was disinclined to indict Donald Trump. The Manhattan District Attorney's Office has now fired back, saying they have no intention of dropping the investigation into Donald Trump, and indentifying the new top prosecutor who will head up the 25-person-team involved in the Trump Organization prosecution. Her name is Susan Hoffinger. Ms. Hoffinger just joined the DA's office this month after being in private practice for decades. Attorney General Merrick Garland spoke directly and at length about the investigation into the attempted overthrow of our democracy on January 6. Garland pointedly said the Department of Justice will hold accountable all January 6 perpetrators "at any level", whether they were present at the Capitol" on January 6 or not. AG Garland also invoked the Watergate scandal and said that, on the accountability front, there will not be one set of rules and norms for "the powerful and one for the powerless."
