Before dismissing the jury at the conclusion of the E. Jean Carroll defamation trial and just after they awarded Ms. Carroll $83.3 million for Trump's incessant defamation - Judge Lewis Kaplan told the jurors that he recommends they tell NO ONE that they served on the Trump jury. Although Judge Kaplan's motivation was undoubtedly to protect the jurors against the danger posed by Trump and his supporters, it's institutional insanity to make everyone else alter their lives and their behavior rather than address the source of the danger - Donald Trump.Trump endangers everyone who is involved in holding him accountable for his crimes and his civil wrongs. This includes witnesses; judges and their staff; prosecutors and their family members; and jurors. Trump is on pretrial release in four felony cases, both state and federal. The law provides that if someone is on release in a felony case, and there is clear and convincing evidence that the defendant poses a danger to even one person in the community, that person should be detained pending trial. Yet instead of doing what the law provides, the institutions of government have decided that every single person involved in the endeavor of holding Trump accountable should alter their lives rather than neutralize the threat by detaining Trump pending trial. A New York jury has issued its verdict in the second defamation case that E. Jean Carroll bought against Donald Trump: Trump must pay Ms. Carroll $83.3 million in compensatory and punitive damages. A year earlier, a jury awarded Ms. Carroll $5 million due to Trump defaming her on other occasions. Moreover, during closing arguments, Trump disrupted the proceedings by storming out when Ms. Carroll's lawyer told the jury that Trump acts like the rules don't apply to him. Of course, Trump's disruptive behavior directly and dramatically proved the exact point Ms. Carroll's attorney was arguing to the jury. Glenn says Donald Trump truly is the biggest loser when it comes to his court cases. He's lost both trials against E. Jean Carroll. He's lost his New York civil fraud trial, and we are simply awaiting Judge Engoron's decision regarding how much Trump will have to pay (or "disgorge"). And, when his namesake, The Trump Organization, was criminally convicted of a 15-year-long criminal scheme to defraud in the first degree, Trump essentially lost that case as well (albeit by proxy as he was not personally charged in that case).Trump fights every case in the court of public opinion. He lies and lies in a desperate attempt to deceive and grift from his gaggle of supporters. But the rules of evidence don't apply in the court of public opinion. However, the rules of evidence, the rules of procedure, and the rule of law all apply in court. And Trump has proven time and again that he can not win in a court of law.His unabated losses in court are strong predictors of how his criminal trials will play out. Today was not a particularly good day for justice. Although Peter Navarro was sentenced to four months in prison for contempt of Congress, the judge DID NOT order him to be taken into custody. This is reminiscent of Steve Bannon, who was also sentenced - back in October 2022 - to four months in prison for contempt of Congress, but has yet to to serve a single day of his sentence. Perhaps worst of all, Donald Trump took the stand today in his defamation trial in New York and, after Judge Kaplan told Trump he was prohibited from calling E. Jean Carroll a liar, Trump IMMEDIATELY called E. Jean Carroll a liar. Yet there was no sanction, no accountability, and no contempt finding.Today wasn't a good day for justice or for the equal application of our laws. Nikki Haley has now lost in Iowa and New Hampshire. But Glenn says don't expect her to drop out of the race for the Republican nomination.
