Judge Chutkan Rejects Trump's Double Jeopardy & Presidential Immunity Claims

Courts Reject Donald Trump's January 6th Immunity Claim

In our longform weekend podcast Glenn runs down his legal recap stories of the week. He begins with the new reporting that Jennifer Little, one of Donald Trump's current lawyers, told a grand jury overseen by Special Counsel Jack Smith that within days of the DOJ issuing a subpoena last year for all the classified documents Trump had at his Florida home, she "very clearly" warned the former president that if he did not comply "it's going to be a crime". Then, newly disclosed text messages between Rep. Scott "Pardon Me" Perry and Trump co-conspirator/co-defendant Jeffrey Clark reveal that Perry was in the thick of Trump's conspiracy to unlawfully cling to power. Glenn says the question now becomes, does the DOJ finally have enough evidence to indict Perry? If you recall, Perry requested a pardon for his apparent crimes on and around January 6th. Next recap story, reported first by The Guardian, "Georgia Prosecutors Oppose Plea Deals for Trump, Meadows and Giuliani." Glenn discusses why this is an important and necessary development in the RICO case. Then, the appellate court in New York reimposed the gag order Judge Engoron placed on Donald Trump in an effort to stop Trump from endangering the court staff. Glenn says more people will get harassed unless his pretrial release is revoked. And finally, a federal appeals court has determined that Trump isn't immune from civil lawsuits related to the January 6th attack at the capitol. Trump's Gag Order Battle Rages On

The Donald Trump gag orders are beginning to cross-pollenate. After Trump posted attacks on Judge Engoron's law clerk in New York, hundreds of threats poured in from Trump's supporters. Special Counsel Jack Smith packaged up the evidence of those threats and filed the information with the appellate court in DC that is deciding the constitutionality of the gag order imposed by Judge Tanya Chutkan in Trump's federal prosecution in DC.Trump's defense attorneys countered by arguing that Trump didn't directly threaten Judge Engoron's law clerk. Trump's New York Fraud Trial Witness Testifies and Ruins Trump's Defense

Last week, Colorado Judge Sarah Wallace entered a finding that Donald Trump engaged in an insurrection on January 6, 2021. However, Judge Wallace went on to rule that the 14th Amendment does not disqualify a president who engaged in an insurrection from again serving as president of the United States. Both parties have now filed appeals in the case. Trump has appealed the judge's finding that he engaged in an insurrection, and Crew - the organization that brought the suit on behalf of Colorado voters - appealed her ruling that Trump is not disqualified by the 14th Amendment. Glenn says one of the important factors in assessing the likely result on appeal involves the different standards of review that are applied to a trial court's factual determinations versus its legal determinations. Then, if you thought the New York fraud trial couldn't get any worse for Donald Trump - it just did. In a colossal tactical blunder, Trump's own lawyer put a witness on the stand that, as the Business Insider reported, "ties (Trump) to the conspiracy." Trump's lawyers called as a witness longtime comptroller for the Trump Organization Jeffrey McConney. After Trump had previously testified that he knew little to nothing about the annual net-worth statements of his own business, McConney testified that the statements were actually provided to Trump for his final review. Indeed, the attorney for the New York Attorney General's office cross-examined McConney with his own hand-written note on the financial documents that plainly stated, " DJT to get final review." Glenn says - in other words, Trump's own lawyers called a witness that blew up their client's defense.
