Wind Or Flood Damage? Arguing A Total Loss Left By Hurricane Ian - Claims Study

In this episode, we have an On-site claim study. A major surge caused by hurricane Ian destroyed a few restaurants and some residential apartments on Sanibel island. Our job is to help the policyholders settle for the policy limit. Property owners will have to remove what is left and build from scratch! So, it makes sense they will receive the policy limit, right? Right?! At the moment of making the video, we still experienced issues with the insurance company; 👉 They paid the maximum amount for flood damage, but not a penny for wind damage yet. 👉 They are waiting on us for the estimate, and I don’t understand why. 👉 And they supposedly sent their engineer, but I haven’t seen a report yet. We are also over the 90-day limit in Florida, so they should have already paid for wind damage. And that is exactly where the problem lies. Public adjusters, take note! No one can argue this isn't a total loss, but we still have to prove the damage not covered by the flood limit happened because of wind. Flood damage has a much smaller limit. So it is the public adjuster’s responsibility to prove and argue for the property owner's benefit. I understand you are worried. I understand many of you will want to leave the restoration industry and do something else. However, it is crucial public adjusters understand what is going on and how it affects us before making big decisions. There are two major changes with a significant impact on the restoration industry. 👉 First, attorney fees and costs are out of the game. So, if you send a claim to litigation, the homeowner covers attorney fees and costs from the settled amount. 👉 Second, the AOB is out the window. AOB allowed us to not worry about covering mitigation costs from contractors. Now that is the homeowner's responsibility as well. All in all, the new senate bill makes it significantly harder for homeowners. And that is exactly why we should continue our struggle and double our efforts in the fight for the homeowner! Therefore, I think as a public adjuster one of the more important things is to hold the insurance companies accountable to these limits! The fact that we have these limits, we need to take advantage of them! We can notify the state, we can file Civil Remedy Notice, etc. Disclaimer: These limits are strictly related to Florida. Have you ever had this happen to you? That a client wants to terminate your contract and find another public adjuster or give up on the claim altogether? Don’t worry, it happens to the best of us, especially in the early days of our careers. But the trick is to do everything possible to prevent your client from leaving. Here’s something to have in mind for your next claim. 👉 Include your client in the communication between you and the insurance company. 👉 Your client has every right to cancel the contract during the rescission period. Terminating a contract after rescission becomes tricky. 👉 Clients are your referrals, so you want to enter and exit the claim with their best interests in your heart. If they want to terminate your contract because your efforts were ineffective, let them and give them a release. However, clients often think you haven’t been doing anything, even if you did everything you could to help their case. If that's the case, show them. Show them the emails and the effort you put in to make their claim successful. There it is, guys. Keep the policyholder in your hearts, and you will get far as a public adjuster!
