BLUE BLOOD LAWYER 'Accidentally' Shoots Wife Dead, Sells Her $350,000 Wardrobe, GETS NEW TRIAL

Tex McIver is a prominent Atlanta lawyer and Vice Chair of the State Elections Board; his wife, Diane, is a beautiful, incredibly successful businesswoman in her own right.  They have been married for 11 years, but on a September night, Tex McIver shoots his wife in the back, killing her. Diane McIver is shot inside a Ford Expedition she is riding in with her husband and a close family friend. They are returning home from their ranch in Putnam County late on Sunday night. Diane is in the front passenger seat, Tex is in the back seat. Dani Jo Carter is driving the SUV back from the Ranch to the Condo in Buckhead when the interstate traffic gets heavy and she takes an exit into Downtown Atlanta.  McIver tells the police it was a bad area and he asked his wife to hand him his gun. He said it was in the center console up front. Diane McIver hands Tex his gun. He later says they are out of danger before falling asleep. He wakes up when Dani Jo stops the car, and somehow the gun is fired.     As friends come to offer condolences on the passing of his wife, most expect to see Tex McIver upset, in shock that he accidentally shot his wife, the love of his life, and caused her death. Instead, they find a man who seems more concerned about money. Within two days of Diane's death, Tex is asking about his wife's Social Security benefits.  Then, Tex McIver seems to be investigating how to liquidate his late wife's assets. He organizes many of his wife's possessions to sell at an auction as part of an estate sale and says he was liquidating things to settle his wife's estate. McIver sold everything he could of his wife's clothing, jewelry, furs, hats, just about everything. The sale lasted several days. It was later revealed that he owed his wife nearly $350,000 which she loaned him for a barn he built on the ranch for guests on their estate Atlanta police eventually decided to charge Tex McIver with involuntary manslaughter and reckless conduct in the shooting death of his wife. The charges seem to suggest that they believe Tex McIver's claim that the shooting was an accident. The day after a judge sends McIver to jail, he is indicted of malice murder, along with six other charges, including three counts of influencing a witness.  Joining Nancy Grace Today: Clint Rucker - Award-winning Attorney, Municipal Court Judge, and Former Prosecutor in Fulton County; Defense Attorney at Garland Samuel & Loeb; Facebook & IG: @clintruckeresq     Dr. Bethany Marshall - Psychoanalyst; Instagram & TikTok: drbethanymarshall, Twitter: @DrBethanyLive; Appears in “Paris in Love” on Peacock  Christopher Byers – Former Police Chief Johns Creek Georgia, 25 years as Police Officer, now Private Investigator and Polygraph Examiner with Lancaster Information Services in Atlanta Dr. Michelle Dupre – Forensic Pathologist and former Medical Examiner, Author: “Homicide Investigation Field Guide” & “Investigating Child Abuse Field Guide”, Ret. Judge Slams 'EMPIRE' Star's Appeal for Conviction of Faking Hate Crime on Self

Empire co-star Jussie Smollett gets released from jail while attorneys appeal his conviction for lying to police about a hate crime attack.  Smollett’s attorneys argued that he would complete the sentence by the time the process was completed. They also cited homophobic threats received by the actor in their request for emergency release. The special prosecutor responded to the motion by saying it was “factually incorrect.” Two of the three members of the appellate court agreed with Smollett’s attorneys.    Well, an appeals court upheld Smollett's disorderly conduct convictions.  He now will have to finish the 150-day incarceration part of his sentence.   Joining Nancy Grace today: Matthew Mangino – Attorney, Former District Attorney (Lawrence County); Author: “The Executioner’s Toll: The Crimes, Arrests, Trials, Appeals, Last Meals, Final Words and Executions of 46 Persons in the United States;” Twitter: @MatthewTMangino Dr. Shari Schwartz– Forensic Psychologist (Specializing in Capital Mitigation and Victim Advocacy); Author: “Criminal Behavior” and “Where Law and Psychology Intersect: Issues in Legal Psychology;” Twitter: @TrialDoc Paul Szych – Former Police Commander (Albuquerque, NM), APD Domestic Violence and Stalking Unit; Author: “Stop Him From KillingThem;” Twitter: @WorkplaceThreat Alexis Tereszcuk – CrimeOnline Investigative Reporter, Writer/Fact Checker at Lead Stories; Twitter: @swimmie2009   Learn more about your ad-choices at https://www.iheartpodcastnetwork.comSee omnystudio.com/listener for privacy information.

Massachusetts Mom Searches "Ways to Kill," Strangles Her 3 Tots Dead With Exercise Bands

When Lindsay Clancy’s third child is born, her recovery seems to be different.   The 32-year-old reaches out to her parents and her in-laws to help her manage the children and things around the home. Her husband, Patrick Clancy sets up a home office in the basement to work remotely, so he can be on hand to help. When Lindsay starts to have thoughts of suicide, and worse, hurting the children, she checks herself into the McLean Psychiatric Hospital,  Five days after checking into a psychiatric hospital Lindsay Clancy is reportedly told she doesn't have postpartum depression. Husband Patrick Clancy tells friends that after her hospital stay, Lindsay seems to be getting better. She is sleeping better, interacting with friends and family, and going out in public without any difficulty. When Patrick Clancy asks his wife if she is having any suicidal thoughts, Lindsay Clancy says "No."    Later on in the year, with his wife having been prescribed at least 13 different medications, Patrick Clancy texts a friend saying he’s concerned that Lindsey has been prescribed too many medications. Patrick allegedly told friends that he worried she was suffering “the worst side effects possible” from one of her prescriptions. He says he thinks she is going through benzodiazepine withdrawal.    On a Tuesday afternoon Lindsay Clancy sends a text to her husband to pick up takeout.  As Patrick Clancy leaves to pick up dinner, Lindsay sends him a text to stop off by the drugstore and pick up some medicine for the children.   Patrick Clancy stops by the drug store to pick up the medication but gets confused as to exactly which medicine to buy. He calls Lindsay Clancy on the phone, but she doesn't answer. She calls back a minute later. Patrick says she sounded like she was in the middle of something. Lindsay answers his question about the medication and Patrick picks it up and heads to the 3V to get their dinner.  When Patrick Clancy comes home, he’s met with silence. He finds his wife in the backyard. She had jumped out of a second-floor window after slitting her wrists. The children are in the basement,  strangled, an exercise band still wound around their necks.   Investigators revealed in court papers that Lindsay Clancy allegedly researched "ways to kill" before the deaths of her three children.  Clancy is in a hospital ward, paralyzed after her second-floor fall, and faces three counts each of murder and strangulation.  Joining Nancy Grace Today: Darryl Cohen – Former Assistant District Attorney (Fulton County, Georgia) Former Assistant State Attorney (Florida), and Defense Attorney: Cohen, Cooper, Estep, & Allen, LLC; Facebook: “Darryl B Cohen;” Twitter: @DarrylBCohen Dr. Angela Arnold – Psychiatrist, Atlanta, GA; Expert in the Treatment of Pregnant/Postpartum Women; Former Assistant Professor of Psychiatry, Obstetrics and Gynecology: Emory University; Former Medical Director of The Psychiatric Ob-Gyn Clinic at Grady Memorial Hospital; Voted “My Buckhead’s Best Psychiatric Practice of 2022” Brian T.
