Despite the Federal Trade Commission (FTC) filing a lawsuit to block Microsoft's acquisition of Activision Blizzard, a federal judge denied the FTC's attempt to delay the deal and approved the acquisition. The judge ruled that the FTC failed to adequately show that the deal would result in harm. Microsoft can now proceed with the $70 billion acquisition as early as this month.
The FTC's antitrust probe against Microsoft over bundling its Teams product into the Office suite was dismissed by a federal judge. The judge stated that the FTC failed to demonstrate that the bundling would result in harm to competition or consumers. Microsoft's CEO, Satya Nadella, and Xbox head, Phil Spencer, both stated under oath that they would not make Call of Duty an Xbox exclusive, debunking the FTC's argument.
Lena Khan, the chair of the FTC, has faced criticism for her handling of antitrust cases, with many perceiving her strategy as vindictive and lacking focus on consumer protection. Critics argue that her actions have undermined the credibility of the FTC and that she should prioritize cases based on clear violations of antitrust laws rather than launching broad attacks against big tech companies.
The FTC has filed lawsuits against Amazon, alleging that it misled consumers about canceling Prime memberships using dark patterns. Lena Khan's FTC has been focused on combating dark patterns, deceptive user experiences designed to manipulate or coerce consumers. The agency has recovered lost wages for Amazon delivery drivers and fined Epic Games for tricking young gamers into making unintended purchases.
As part of its acquisition of Activision Blizzard, Microsoft has signed a 10-year deal with Nintendo to bring Call of Duty and other major games to the Nintendo platform. This move contradicts the FTC's argument that Microsoft would make Call of Duty an Xbox exclusive, as it expands the availability of the game to millions of additional players.
