In Bocke, four justices said that you can't discriminate based on race even in favor of minorities under the 1964 Civil Rights Act. That's been reaffirmed several times in slightly different permutations since then. But I think what is clear to me at least is in each case, the Supreme Court says, okay, we're going to let you use race, but we really disfavor it.
