The court began its substantive discussion in bowers as follows. The issue presented is whether the federal constitution confers a fundamental right upon homosexuals to engage in sodomy, and hence invalidates laws of many states that still make such conduct illegal. That was 19 years ago. So the court then goes through their list. Rather like my failure to fly speck sam melido's list of a laws criminalizing abortion, they basically go through the list quibble with each and every one of them.
