The Substantial Similarity Test
There is a thing in US law that does exist, I think it's called a substantial similarity test where you can have copyright sort of to a story if it's original enough. But it's not a very simple test at all. If you read case law opinions that delve into this kind of thing, they look like basic Larry literary criticism. It's a complex question.
