Deontologists, r i think, would be a much higher barba. You have to distinguish between a utilitarianism of rights and strictly dontological view. In some versions of elancoly an absolute prohibition on a killing innocence in order to prevent them from violating rights down the line. Yes, i could see ways around it, but again, that would be a point of disagreement rather than one of clarification.
