In 1990, there was a mini scandal in Washington, DC. They were getting between 90% and 100% of all minority business enterprise contracts from the federal government. I've never seen anyone justify why an immigrant from India who's been here five or six years should get a preference over say, anybody really who's who's born in the United States. There isn't any good reason.

David E. Bernstein holds a University Professorship chair at the Antonin Scalia Law School, George Mason University, where he has been teaching since 1995.
