The law is not dependent on retributivism. No, but in many states, ours included part of the justification for punishment. In fact, the new model, pedal code, doubles down on retributivism as the primary justification. We are more allies than we are foes when it comes to reforming the criminal justice system. But i think you inadvertently leave too much on the field to to satisfy the retributivist.
