This case should have been dismissed as m rse's nothing to decide. The clean power plan was never in effect. There is no plan to put it into effect. All of the emissions metrics have been met. Even if you put it into efect, it would not create any obligations on anyone. It is, quite literally, nothing more than words on a piece of paper. At this point,. the only reason to hear this case is to use it as an excuse to attack the administrative state.
