Randy Cevallos: Most of the Equal Protection properly considered would apply to executive action rather than legislative action. He says police in Reconstruction South or all the way up through Jim Crow may be not protecting African Americans from murder. All three branches of government have a role to play in extending the protection of the laws, he says.
