OpenAI's structure changed when it realized it needed more capital. It became a nonprofit with a subsidiary capped profit. The nonprofit still controls everything and makes non-standard decisions. This structure protects them from making decisions not in the shareholders' interest. In 2019, they made the leap from nonprofit to capped for profit for more financial flexibility with pros and cons to consider.
