Clarity of Authority under the FTC Act
The Federal Trade Commission (FTC) has the authority to issue rules and regulations as per the FTC Act of 1914. This authority was utilized to create significant legislative rules such as the cigarette rule requiring health risk disclosures on cigarette packs. Challenges to this authority were brought to the DC and seventh circuits, both of which upheld the FTC's authority. Subsequent amendments to the FTC Act by Congress further clarified and reaffirmed the FTC's authority to issue rules, explicitly referencing it in the statutory language.
