Examining the Impact of Civil Adjudication on Gun Rights
The big question is whether or not the fact that this case is a civil adjudication and not a criminal case will matter to the justices. Some federal courts have ruled that laws preventing felons from having firearms are unconstitutional, but this is a different case. There is uncertainty about how Clarence Thomas and Neil Gorsuch will view it, as well as James Ho, who wrote an opinion claiming that restraining orders are abused by women. Kavanaugh and Roberts, however, believe in reasonable limits on the right to bear arms, including mental health restrictions. Amy Coney Barrett's stance is unclear.
