The Obama Administration's Statement on Stereotypes
Okay, so the question is, why do the office for civil rights, and rather than, or in place of an explanation for what gender identity is, simply asserted that the conventional understanding of sex that it's meant to replace is an outdated stereotype and therefore legally impermissible. And the answer has to do with the second component of the Dear Colleague letter that I found fascinating, which is that the Obama administration said that it was really doing nothing new, that it was merely clarifying decades of federal case law that had already come to this conclusion.
