Creditors are looking for their claims to be paid back, but for most customers, it may not feel like a win if they only receive their initial claim after having their capital tied up without realizing market returns. Customers are expecting to receive any value available rather than it going to equity holders, even if compromises are necessary for it to align with bankruptcy regulations.

I was joined by Erin Broderick, Head of U.S. Cross-Border Restructuring & Insolvency at Eversheds Sutherland.
