Moving Towards Federal Regulation in AI
The concern is that having individual state AI bills would lead to compliance challenges. The optimal solution may lie in federal preemption of state laws due to issues such as lack of expertise, vulnerability to capture, and lack of unique local conditions at the state level. A top-down design would suggest that state-level regulation of AI is not ideal and a single national approach, similar to the EU's harmonized approach, would be more efficient. This shift towards federal regulation could provide a more cohesive and effective framework for regulating AI, although there is still a long way to go before reaching that point.
