Episode 5 - The Importance of the Broker Trust Account, Featuring Allison Disarro, Senior Vice President of Property Management Banking at Seacoast Commerce Bank

Bob discusses the concept and importance of the Broker Trust Account for property management companies with Allison Disarro, Senior Vice President of Property Management Banking at Seacoast Commerce Bank. Real estate brokers and property management companies receive and hold funds in their everyday course of business from tenants and property owners for rent payments or property improvements. Property managers must accept, control and account for these "trust funds" within compliance under State of California Bureau of Real Estate standards. The improper handling of trust funds can put the monies at risk and may be cause for the suspension of a Broker's license. As such, it is very important for homeowners considering renting their properties to hire a property manager that has a properly established and documented Broker Trust Account. Allison provides her expert explanation of the importance of the trust account, how these accounts should be set up, and what questions a homeowner can ask of their property manager to make sure their owner funds are properly deposited and protected. Episode 4 - The Future of Short Term Rentals, Featuring Dwight Worden, Mayor of the City of Del Mar, California

Bob discusses the future of Short Term Rentals (STRs) with Dwight Worden, the Mayor of Del Mar, California. Bob and Dwight cover the new ordinance put in place in Del Mar to regulate rentals, room sharing, and house exchange of less than 30 days in duration. Sometimes referred to as Vacation Rentals, STRs have grown in popularity in many communities and neighborhoods throughout North County San Diego (Cities of San Diego, Del Mar, Solana Beach, Encinitas, and Carlsbad). The growth of the "sharing economy" and the online explosion of STR websites such as Airbnb, VRBO, HomeAway, and FlipKey have increased the number of property management companies and individual homeowners offering furnished homes to vacationers. This is not unique to North County San Diego, but is occurring in residential neighborhoods all over the world. This has rapidly become an emotionally charged topic, as conflict can occur between property owners who want to profit from short term renting and others who see STRs as turning their neighborhoods into commercial hotel zones. This episode is not intended to determine a right or wrong answer to this issue, but rather explores what City Councils are doing, now and in the future, in regard to STR regulation, zoning, and enforcement. Episode 3 - Legal Aspects of Being a Landlord in the State of California, Featuring Ted Smith of Ted Smith Law

Bob discusses the importance of understanding California landlord-tenant laws with Ted Smith, the owner and principal at Ted Smith Law in San Diego, CA. Being a landlord or property manager in California requires awareness of specific federal and state laws as well as local ordinances pertaining to renting to tenants. Some of the common legal pitfalls include violating fair housing laws, security deposit charges, how much can be charged for a tenant screening, procedural timing on serving notices for ending tenancy or if a tenant is late on rent. There are also many disclosures regarding environmental hazards, property particulars, and even bedbugs. Failure to follow the proper legal protocol could lead to lengthy and expensive disputes with a tenant and possibly financial penalties. In this episode, Bob and Ted cover many of the key legal aspects pertaining to being a landlord and why individual homeowners with the desire to rent their property should consider hiring a property manager rather than trying to do it themselves. Ted also offers many legal insights and some important guidance on staying in compliance during the rental process.
