Sally Engle Merry, “The Seduction of Quantification: Measuring Human Rights, Gender Violence, and Sex Trafficking” (U. of Chicago Press, 2016)

Quantification is not usually the first thing that comes to mind when hearing or reading about the United Nations High Commission on Human Rights (OHCHR). Yet in the 21st century, a wide range of policy and advocacy agendas begin with numbers. Those numbers become indicators, composites, standards, and measurement tools, which then get adopted in advocacy rhetoric or policy practice.In The Seduction of Quantification: Measuring Human Rights, Gender Violence, and Sex Trafficking (University of Chicago Press, 2016), Sally Engle Merry combines ethnography, human rights, and science and technology studies to explore how people living in vulnerable situations across the globe are represented by the numbers designed to both name and support them. While numbers do not have agency, and cannot help or hurt on their own, Merry dedicates most of the book to untangling the politics and practice of developing standards and indicators, and interpreting the realities that come with “governance by numbers.” The genealogy of these indicators and standards are given as much space as their application, as Merry describes their highly political origins and a process of their subtle acceptance as normalover time.With roots in colonial authority and population management, indicators have been developed and used for a range of purposes in governance: to manage people, resources, planning, dissent, and reputations among others. Merry explores indicators and indices from legal, anthropological, historical, and genealogical perspectives, describing a range of unexpected stewards from short-term United Nations consultants to U.S. State Department officials to computer algorithms. While the book focuses on the globalization of definitions, measurements, and management techniques, it simultaneously explores the widely varied phenomena of gender violence, human rights, and human trafficking. On a set of topics that have been broadly fetishized, the overlay of quantified assessments and accompanying responses to them raises many questions about voice, politics, and international policy-making among many other topics. Jonathan Todres and Sarah Higinbotham, “Human Rights in Children’s Literature: Imagination and the Narrative of the Law” (Oxford UP, 2016)

How can children grow to realize their inherent rights and respect the rights of others? In Human Rights in Children’s Literature: Imagination and the Narrative of Law (Oxford University Press, 2016), authors Jonathan Todres and Sarah Higinbotham explore this question through both human rights law and children’s literature. Both international and domestic law affirm that children have rights, but how are these norms disseminated so that they make a difference in children’s lives? Human rights education research demonstrates that when children learn about human rights, they exhibit greater self-esteem and respect the rights of others. The Convention on the Rights of the Child — the most widely-ratified human rights treaty — not only ensures that children have rights, it also requires that states make those rights “widely known, by appropriate and active means, to adults and children alike.” This first-of-its-kind requirement for a human rights treaty indicates that if rights are to be meaningful to the lives of children, then government and civil society must engage with those rights in ways that are relevant to children.Human Rights in Children’s Literature investigates children’s rights under international law — identity and family rights, the right to be heard, the right to be free from discrimination, and other civil, political, economic, social and cultural rights — and considers the way in which those rights are embedded in children’s literature from Peter Rabbit to Horton Hears a Who! to Harry Potter. Katherine Turk, “Equality on Trial: Gender and Rights in the Modern American Workplace” (U. of Pennsylvania Press, 2016)

Katherine Turk is assistant professor of history at University of North Carolina, Chapel Hill. Her book Equality on Trial: Gender and Rights in the Modern American Workplace (University of Pennsylvania Press, 2016) explores how women tested the boundaries of work place equality following the passing of the Title VII of the 1964 Civil Rights Act. The under staffed Equal Employment Opportunity Commission was given the task of interpreting the ambiguous meaning of sex equality. Thousands of letters flooded the commission appealing to broader notions of fairness and sexual equality. The ambiguity of the law allowed women to assert expansive interpretations to include safer workplaces, higher wages, flexible schedules, equal pay and comparable worth. The EEOC struggled to apply the law as it dealt with sex-specific protective state laws, industry practices and common sense notions of gender. The backlog of claims pressed the EEOC to narrow the definition of sex equality and turned to statistics in developing cases to be tested in the courts. Turk examines multiple legal cases, union and industry conflicts that shaped the limits of sex equality falling short of fundamental change for working class women. Ayten Gundogdu, “Rightlessness in an Age of Rights: Hannah Arendt and the Contemporary Struggles of Migrants” (Oxford UP, 2015)

How does one “rethink and revise the key concepts of Hannah Arendt’s political theory in light of the struggles of asylum seekers, refugees, and undocumented immigrants” (207)? In her new book Rightlessness in An Age of Rights: Hannah Arendt and the Contemporary Struggles of Migrants (Oxford University Press, 2015), Ayten Gundogdu (Political Science, Barnard College) engages this question to explore both a radical critique and radical rethinking of human rights in our age. The book challenges and reimagines central dimensions to Arendt’s thought – rightlessness, the political and the social, personhood, labor and work, and the ‘right to have rights’ – at the same time that it provides incisive analysis of the precarious conditions of and political action by migrants. The book works with Arendt to offer important critiques of a number of aspects of contemporary human rights theory and practice, and ultimately develops an approach to human rights as “political practices of founding.”John McMahon has recently completed his PhD in Political Science at The Graduate Center, CUNY, and will be Visiting Assistant Professor in the Department of Political Science at Beloit College starting in August 2016. Daniel K. Williams, “Defenders of the Unborn: The Pro-Life Movement Before Roe v. Wade” (Oxford UP, 2016)

Daniel K. Williams is an associate professor of history at the University of West Georgia. His book, Defenders of the Unborn: The Pro-Life Movement Before Roe v. Wade (Oxford University Press, 2016) offers the origins of the pro-life movement not as reactionary and anti-feminist, but rather as a New Deal-inspired crusade for human rights and part of a progressive Catholic social agenda. Pro-lifers saw themselves as crusaders for the “right to life” appealing to natural law and the constitution of the United States. In the 1930s they stood against the utilitarian views of abortion liberalization promoted by secular doctors. After World War II Catholic doctors and lawyers were equating abortion with the holocaust and arguing for the fetus as protected by the United Nations Declaration of Human Rights. In the early 1960s, the debate over abortion moved to legislative and constitutional battles. Restrictive state laws began to crumble and post-Vatican Catholic opposition to abortion continued to erode among the laity. The decade ended with a restructuring of the movement as it gained allies among young progressives, anti-war activists, Protestants and evangelicals. Pro-life women, expressing a feminism of difference, became visible in the leadership ranks in what had been a virtually an all-male public campaign. The pro-life movement’s legislative victories were short term. Roe v. Wade and change in public opinion interrupted the ascendancy of the pro-life movement and its bipartisan identity to become part of a larger cultural battle. Samuel Moyn, “Christian Human Rights” (U of Pennsylvania Press, 2015)

Samuel Moyn is Professor of Law and History at Harvard University. In Christian Human Rights University of Pennsylvania Press, 2015), Moyn provides a historical intervention in our understanding of how the idea of human rights in the mid-twentieth century came to be. He argues that contrary to current thought, that sees it as part of the long-legacy of Christianity, or the triumph of liberal democracy, it has a more complicated history. The notion of human rights was inspired by a defense of the dignity of the human person. It first arose just prior to WW II as part of the reformulation of the liberal idea of human rights, deemed morally bankrupt, taken up by conservative religious thinkers. Moyn argues that the long-held Christian concept of moral equality of human beings did not translate into political rights. Rather the reformulation of human rights in the 1940s was a Catholic communitarian defense against totalitarian, capitalism and political secularism. The language of rights was extricated from the legacy of the French Revolution “rights of man” to become a religious value checking the political power of the state with religious freedom as a key concept. The philosophy of “personalism” articulated by Jacques Maritain recast democracy and human rights in a Catholic vein becoming enshrined in the Universal Declaration of Human Rights and in the ascendancy of Christian democratic parties at mid-century. Secularized after the 1960s, human rights became an increasingly uninspiring concept unable to do the work it promised. Anita Weiss, “Interpreting Islam, Modernity, and Women’s Rights in Pakistan” (Palgrave Macmillan, 2015)

Pakistan is often caricatured and stereotyped as a volatile nuclear country on the precipice of disaster. Such depictions are often especially acerbic when comes to the issue of Women’s rights in the country. In her important new book, Interpreting Islam, Modernity, and Women’s Rights in Pakistan (Palgrave Macmillan, 2015), Anita Weiss, Professor of International Studies at the University of Oregon, provides a much-needed corrective to such sensationalist stereotypes. By exploring how multiple state and non-state actors have engaged the question of gender and women’s rights over time and space, Weiss demonstrates ways in which a diversity of voices in Pakistan conduct what she calls “everyday Ijtihad,” thus offering a much more nuanced and informed perspective. In our conversation, we talked about a range of issues such as the history of the Pakistani state’s approach towards defining and engaging women’s rights, the role of Progressive NGOs like the Aurat Foundation, Orthodox Islamist voices on this question, and the Tehrik-i Taliban in Swat. Alice J. Kang has written Bargaining for Women’s Rights: Activism in an Aspiring Muslim Democracy (University of Minnesota Press, 2015). Kang is assistant professor of political science and ethnic studies at the University of Nebraska-Lincoln.Much attention is paid to Muslim-majority countries across the Middle East, especially the contentious role of women’s rights in those countries. Less attention has been paid to Muslim democracies in Africa. Kang’s book focuses on the politics of women’s rights in one such country: Niger. Women’s rights activists in Niger have fought to participate in democratic governance, but haven’t won every recent battle. Kang highlights several successes as well as policy areas where women’s organizations have failed to win policy victories. Saba Mahmood, “Religious Difference in a Secular Age: A Minority Report” (Princeton UP, 2015)

It is commonly thought that violence, injustice, and discrimination against religious minorities, especially in the Middle East, are a product of religious fundamentalism and myopia. Concomitantly, it is often argued, that more of secularism and less of religion represents the solution to this problem. In her stunning new book Religious Difference in a Secular Age: A Minority Report (Princeton University Press, 2015), Saba Mahmood, Professor of Anthropology at the University of California at Berkeley, brings such a celebratory view of secularism into fatal doubt. Through a careful and brilliant analysis, Mahmood convincingly shows that far from a solution to the problem of interreligious strife, political secularism and modern secular governance are in fact intimately entwined to the exacerbation of religious tensions in the Middle East. Focusing on Egypt and the experience of Egyptian Copts and Bahais, Mahmood explores multiple conceptual and discursive registers to highlight the paradoxical qualities of political secularism, arguing that majority/minority conflict in Egypt is less a reflection of the failure of secularism and more a product of secular discourses and politics, both within and outside the country. In our conversation, we touched on the salient features of this book such as the concept of political secularism and its applicability to a context such as Egypt, the genealogy of minority rights and religious liberty in the Middle East, discourses of minority rights and citizenship in relation to the Egyptian Copts, the discourse of public order and the regulation of Bahai religious identity and difference in Egypt, secularism, family law, and sexuality and the category of secularity and particular understandings of time, history, and scripture brought into view by the controversy generated in Egypt by the novel Azazeel. This theoretically rigorous book is also wonderfully written, making it particularly suitable for graduate and undergraduate courses on Islam, the Middle East, secularism, religion and politics, gender and sexuality, and theories and methods in religion.
