Mitch McConnell has packed the federal courts with 220 judges. Some are already handing down opinions ranging from dubious to destructive of diversity, like Judge Justin Walker deciding that a photographer use her religious beliefs to discriminate against a same sex couple to Judge Neomi Rao who has issued "widely mocked" dissents and had her legal opinion/reasoning reversed by the full court of appellate judges. Civic engagement by the citizenry is more important now than ever. A Citizens Brigade of Court Watchers can attend court hearings - all of which are open to the public - and keep an eye out for judicial misconduct, particularly by the Mitch McConnell judges who were rated "not qualified" by the American Bar Association but Mitch McConnell rammed them through the confirmation process anyway. Upon spotting the judicial misconduct, the court watcher can fill out a short, simply "Judicial Misconduct form and forward it to uscourts.gov in an effort to hold McConnell judges accountable. During her Supreme Court Confirmation hearing, Amy Coney Barrett used something she called super-precedent as a fancy legal-sounding vehicle to hide her ideological preferences. Ignoring all advice from the Center for Disease Prevention and Control, Trump gathers the rich, the powerful, the influential and the connected together at the White House for a special super-spreader event. The "masters-of-the-universe" crowd (h/t to Thomas Wolfe's Bonfire of the Vanities), decides to ignore all CDC guidance: no masks, packed shoulder-to-shoulder, lots of hugs and kisses. The political titans apparently believe that their wealth, status and influence serve as a magical shield, protecting them from the coronavirus. Now, one after another, they are testing positive. On another front, Trump has no less than 10 doctors in crisp, white lab coats closely and carefully monitoring his every vital sign as he sends DOJ attorneys into court to fight like hell to take health care away from tens of millions of America. All indicators are pointing to Trump losing the upcoming election in a landslide. The prevailing wisdom is he will then file legal challenges in various courts contesting the election results. Based on legal doctrines such as "forfeiture by wrongdoing" and the "clean hands" doctrine, Trump will get laughed out of court by the judges. My good friend, retired police officer Brett Parson, pioneered the Washington D.C. Metropolitan Police Department's LGBTQ+ Unit. His work received Harvard University's Kennedy School of Government Innovation in Government Award, complete with a $100,000 grant used to replicate the model in other police departments around the country.  As you all know, I haven't had any guests on "Justice Matters." So I am proud to have Brett as my first guest to talk about his experiences as a police officer for three decades. Brett is the quintessential police officer, understanding that all victims are not the same, all witnesses are not created equal and all suspects are unique individuals whose rights must be scrupulously honored. Bill Barr tasked U.S. Attorney John Durham with going on a witch hunt - investigating the Trump-Russia investigators - in efforts to undermine the origins of the Russia investigation, notwithstanding the fact that the Mueller Report AND the DOJ Inspector General (IG) Horowitz report AND the Senate Intelligence Committee reports all concluded that the Trump-Russia investigation was properly opened. Barr is looking for a different answer - one that helps Trump and hurts Biden. Hence, the Durham investigation.  One of Durham's top prosecutors, Nora Dannehy, abruptly resigned due to Barr pressuring Durham to issue an interim report PRIOR TO the election. Barr conduct is dead wrong in two ways: first, prosecutors do not issue reports. In my 30 years as a federal prosecutor, I never once issued a report. Second, nothing should be done by prosecutors within 60 days of a presidential election that could impact public opinion about the candidates. Barr violates all DOJ norms, protocols, traditions and ethical standards by pressuring Durham to issue an interim report so close to the election. EDITED: I mistakenly state that election day is "November 4, 2020." It is November, 3, 2020. My apologies for the error.  Trump and his nefarious associates believe they have perfected exploiting the delay in the court system to run out the clock and never be held to account. The fix is not as difficult as you might think.  There's an abundance of specialized courts created to deal with specific types of cases. For example, there are drug courts, mental health courts, juvenile courts and domestic violence courts. In federal district court in Washington, DC, for example, there is reentry court.  Creating these courts do not require an act of Congress. It simply takes the judicial branch--a co-equal branch of the government--to recognize a particularized need in the criminal justice system and instituting common-sense rule changes to address the need.  If there was ever a need to address a deficiency, it is in the way nefarious actors exploit the delay inherent in the system. DC federal district court can easily remedy this weakness by creating an Inter-Branch Dispute Court (IBDC). When legal disputes erupt between the executive and legislative branches, like the need to enforce the House of Representatives' subpoena for Don McGahn's testimony in the impeachment inquiry, the IBDC can give the parties 72 hours to file their briefs, another 72 hours to present their oral arguments and the court decision would be entered within 72 hours of the conclusion of those arguments. The appeals court can follow the same 72/72/72 time table. Justice can be done in a matter of weeks, as opposed to the Trumps and McGahns of the world delay justice for months or years.
