The House Select Committee investigating the January 6 attack on the US Capitol is seeking phone records from telecommunications companies as part of its investigation. House Minority Leader Kevin McCarthy told the telecommunications companies not to comply with the Congressional requests and threatened that if they did, the GOP "would not forget it" once they are in power. This is a brazen act of obstructing a congressional investigation. The Department of Justice must address this promptly or else there likely will be more obstructive conduct by McCarty and perhaps others, as lawlessness begets lawlessness. In a move that is deeply damaging to the credibility and legitimacy of the US Supreme Court, the Court declined to stop an unconstitutional Texas law from going into effect. The Texas authorities passed a law saying a woman can not have an abortion after a fetal heartbeat is detected - at about 6 weeks of the pregnancy - which directly violates the Supreme Court precedent of Roe v. Wade. In a very real sense, the Supreme Court is allowing the state of Texas to violate the constitutional rights of women. Florida Judge John C. Cooper tells Governor Ron DeSantis - in substance - to go pound sand, ruling that DeSantis can not stop Florida schools from requiring masks to protect children, teachers, staff and, by extension, all Floridians. But Judge Cooper didn't stop there - he also issued an injunction prohibiting the state from retaliating against school boards that require students to wear masks to protect against the spread of the coronavirus. Michigan Federal District Court Judge Linda Parker issued a scathing, 110-page opinion sanctioning nine pro-Trump lawyers for their lawsuit that was an abuse of the judicial system designed to corruptly undermine Americans' faith and confidence in the results of the 2020 presidential election. Judge Parker also directed that her opinion be provided to the state bar authorities where each lawyer is admitted to practice for investigation and possible suspension and disbarment. Two good news stories broke today on the justice front: 1. Rudy Giuliani's criminal associate, Igor Fruman, will be pleading guilty in federal court in New York on Wednesday. This spells real trouble for not only Rudy Giuliani but for Donald Trump as well. 2. The House Select Committee investigating the January 6 insurrection took steps today signaling that the committee will be subpoenaing the cell phone records of members of Congress to explore their possible complicity in the insurrection. Attorney General Merrick Garland and the Civil Rights Division of the Department of Justice announced it is launching a third "pattern or practice" investigation, this one of the Phoenix, AZ, Police Department. This is the third such investigation undertaken by the Biden administration, with the other two being Minneapolis and Louisville. Notably, the DOJ press release announces that it will not only be investigating possible systemic excessive force and racially disparate policing, but it will also investigate how the Phoenix Police treat the homeless population, how they deal with citizens with disabilities and whether they retaliate against citizens for exercising thier 1st Amendment rights. Former Congressman Doug Collin is now representing Donald Trump (I assume he got his retainer check up front). Collins just sent a truly remarkable letter to former acting Attorney General Jeffrey Rosen regarding Rosen's upcoming appearances before Congress to testify about his conversations with Donald Trump. In a letter that should be studied by law students in a class called "Bad Lawyering 101", Collins asserts that it is unlawful for the Biden administration/the Department of Justice to waive executive privilege and allow Rosen and other DOJ officials to testify. But rather than saying that Collins will therefore bring a legal challenge to prevent the testimony, he instead says that because Donald Trump doesn't want to create a "distraction", they will not "seek judicial intervention" to stop the DOJ officials to testify about their conversations with Trump.
