Attorneys Mathew Kerbis and Lauren Lester kick off their joint series on How to Run a Law Firm in 2025!In a candid discussion about choosing business entities for law firms, Mathew and Lauren share their experiences and insights for new lawyers starting or running their own practices. Both initially chose to form LLCs, with Lauren using Google for research nine years ago and Mathew following the example of previous firms where he worked and checking with his state’s Supreme Court. They emphasize that while the entity choice is important, new lawyers shouldn’t let perfect be the enemy of good enough when starting out. Both started as single-member LLCs with pass-through taxation. Lauren transitioned to S corporation taxation status years later while Mathew is planning to do so in the near future. They stress the importance of working with CPAs for tax matters, maintaining separate business and personal finances, and building up a financial cushion before taking regular payments from the business. Happy New Year! It was a banner year for Law Subscribed. We crossed 100 episodes and got high quality and high profile guests for the podcast. There are a lot of new subscribers to Law Subscribed so I wanted to welcome the new folks and provide some updates to longtime subscribers. I’ve updated paid subscriber benefits to get shows early, and I plan on hosting office hours for paid-only subscribers in 2025. I don’t know what this will look like for free subscribers, but know that shows will still air on Fridays free for all. (101.5) AI’s Impact on Competence and Fees: Ethically Become a Lawyer of the Future (Presented Live at NiftyCON 2024)
This is the recording of my live CLE presentation at NiftyCON in 2024 called AI’s Impact on Competence and Fees: Ethically Become a Lawyer of the Future.The CLE goals are: (1) learn to ethically incorporate AI into legal practice; (2) differentiate between various AI tools; and (3) learn about the most profitable and ethical billing methods. No CLE credit is available for listening to this podcast, but the content will still be super valuable and still worth a listen. In this talk, I share my journey from traditional practice to leveraging AI to revolutionize legal services. I argue against the billable hour (to no one’s surprise), presenting AI as not just a tool for profitability but an ethical necessity for modern legal practice. I focus on the ethical obligations on competence in technology and fair fee arrangements. I explain the concept of Retrieval Augmented Generation (RAG) for improving AI’s accuracy and stress the importance protected communications and client data security. I spend a good deal of time highlighting the distinction between legal-specific AI tools and general-purpose AI, emphasizing the need for legal AI to prioritize confidentiality and reliability (a/k/a using RAG).I argue that attorneys must use the subscription model since it aligns with ethical obligations to not bill clients by using wasteful procedures, and it promotes efficiency and transparency. I share practical tips for implementing subscription legal services, including pricing strategies.
