The Juliana Case: Young plaintiffs sue US government over climate change
The Juliana case, officially known as Juliana versus the United States, involves 21 young plaintiffs suing the US government over its policies that support and encourage fossil fuel extraction. The case focuses on the government's affirmative acts that have put young people in danger and continue to enhance the climate crisis. The lead attorney on the case, Julia Olson, emphasizes the importance of holding the government accountable and seeking remedies to stop the climate emergency from worsening. Amended Complaint and Settlement Conference
After facing challenges in 2020, including a ruling that the plaintiffs didn't have standing to bring the case, the Juliana case was given a second chance when the Ninth Circuit Court of Appeals sent it back to District Court in Oregon. The plaintiffs filed an amended complaint, which focused on obtaining a declaratory judgment on whether the government violated the constitutional rights of young people. The case is currently awaiting a decision from Judge Aiken on whether to accept the amended complaint.
Republican Attorneys General's Intervention and Concerns about DOJ
Republican Attorneys General from 18 states, through a motion to intervene, sought to join the Juliana case for specific purposes, particularly to prevent any settlement from happening. Their involvement raised concerns about their political agenda and potential impact on the case. Julia Olson does not see a significant difference between the Biden administration's Department of Justice and the one under the Trump administration. She believes there is an overcorrection happening within the DOJ, which could potentially hamper progress on climate and energy policies. Judge Aiken has yet to rule on the intervention motion and the amended complaint, and the case awaits her decision.
