Only Congress can create or close a government agency like the Department of Education. However, the six right-wing Supreme Court Justices ruled that Trump can continue his efforts to close the Department of Education even though it clearly violates the doctrine of separation of powers.

Justice Sotomayor authored a powerful and persuasive dissenting opinion, exposing the illegality and unconstitutionality of what Trump is doing, and highlighting the danger to American democracy when the Supreme Court condones Trump's lawlessness.
