German real estate group Adler’s UK restructuring plan secured its place in legal history recently as the English Court of Appeal allowed an appeal by a group of dissenting noteholders, overturning the High Court’s April 2023 decision to sanction the plan. This is the first time the UK’s restructuring plan tool – which came into force in 2020 – has been considered by the appellate court.
