- Two states (California and Washington) wanted to implement more frequent and longer rest breaks for drivers in their states.
- The trump admin controlled FMCSA said “no, commerce is interstate, having a federal standard for rest breaks will keep things safer than having a state by state standard”
- Now the biden admin controlled FMCSA is backtracking on that, saying to the states “if you can prove safety is enhanced both intra and inter state with your rules, you can petition the FMCSA for an exemption to the federal rest break standards.”
- Proponents say “Yay! More rest for drivers!”
- Opponents say “no, this means longer transit times and freight delays specifically to freight moving in those two states”
