Deep dives
Digital asset anti-money laundering act threatens cryptocurrency industry
The Digital Asset Anti-Money Laundering Act of 2023, sponsored by Senators Elizabeth Warren and Roger Marshall, aims to impose bank-like regulations on decentralized internet network participants, such as digital asset wallet providers, unhosted wallets, miners, and nodes. The bill requires entities and individuals to know the customer information of every person involved in a transaction, which is impractical and virtually unenforceable for decentralized activities like running software or mining. This bill, presented in the wake of FTX collapse and geopolitical events like the Russian invasion of Ukraine, takes an extreme approach that seriously infringes on individual privacy and creates obstacles for innovation in the cryptocurrency industry.
Privacy rights and the value of anonymity in cryptocurrency transactions
The bill's attack on privacy rights is highlighted by the recent addition of the decentralized application, Tornado Cash, to the specially designated foreign nationals list due to alleged use by North Korean hackers. While privacy-enhancing tools like Tornado Cash can be utilized by criminals, obfuscating the origin of funds is a legal and legitimate aspect of privacy. It is not money laundering unless the origin of funds is linked to criminal activities. Protecting privacy in digital transactions is crucial for individuals both nationally and globally, as it ensures freedom, security, and the ability to support causes without unwanted scrutiny.
Coin Center's fight for financial privacy and constitutional rights
Coin Center, a nonprofit organization, is actively challenging the unconstitutional aspects of the digital asset anti-money laundering act. They are advocating for the protection of financial privacy and pushing back against forced re-intermediation in the cryptocurrency industry. Through legal action, comment submissions, and educational resources, Coin Center is working to preserve the fundamental rights of individuals to engage in private financial transactions and maintain control over their personal data. To support Coin Center's efforts, individuals can donate to their cause and stay informed about their ongoing work.
Alex talks with CoinCenter’s Director of Research Peter Van Valkenburgh about the Digital Asset Anti-Money Laundering Act and other issues regarding privacy and crypto. Alex also talks with Beimnet Abebe (Galaxy Trading) about markets and macro.
