Mediation is a method of negotiation used in almost every divorce, whether you go to court or not. It's important to understand that typical mediation involves both spouses and one mediator who is trying to help both sides come to a settlement. The mediator is not more inclined to one party over the other, and that can be difficult for some people in the process. You can have a lawyer to help you through the mediation process, and in some states you are required to have your own lawyer sign off on the final mediated terms.
