Is There a Limitation on the Punitive Damages?

If the state can completely ban something consistent with the constitution, it's not clear why they can't delegate enforcement of that band to private citizens using a bounty system. I think there is an argument still, about the structure and amount of the penal damages. Sol you there will be litigation about it. i don't know whether there's likely to be successful constitutional arguments.
