In Georgia under the Rico statute again assuming that's where she's going you have to charge a criminal enterprise now it does not need to be an actual legal entity. No there is no First Amendment exception for committing criminal conduct for agreeing to commit a crime or actually doing so Again conspiracy even if you entered into agreement that's not enoughYou actually have to take an overt act in furtherance of that conspiracy to be guilty of a conspiracy.
