The president has a certain degree of discretion and that includes discretion to withhold the commissions. jefferson believed that marshal was a loose lounging tavern seeking sort of guy who like to have a glass of ale with common people in taverns. i think what drove jefferson nuts about marshal is that he was a virginia federalist and jefferson thought there cannot be a virginiaFederalist if you're a virginian you're not a federalist.
