Marshall's Legacy in American History
Marshall was doing the best that could be done in his mind under a very complex kind of a no win sort of situation. He's controversial to this day, but you can't realistically have expected him to deny the doctrine of discovery or say that the Cherokee had rights they absolutely must respect. The states were much more ruthless with respect to Native Americans than the national government. And I as a historian and as a advocate for Native American rights would rather have Marshall to do this than the people.
