John Jay Refused to Appoint a Chief Justice
President John Adams had the chance to appoint a new Chief Justice after Oliver Ellsworth's resignation. He wanted someone sympathetic to the Federalist cause, and he rushed to try to get his allies sworn in. In January 1801, President Adams received a letter from then-Supreme Court Justice John Jay saying Marshall would not be right for the job. If Jefferson becomes president, "the irony would be delightful," says David Frum.
