The presenter has been interviewed under caution by the police. The law at the moment says that this is a private matter. But it's not clear where the boundaries now lie, as seen in ZXC and Bloomberg cases. I don't think libel defamation comes into it - the sun is pretty sure of its facts. And for the BBC to weigh 1% against other presenters against the interests of the organisation as a whole would be wrong.
