The Importance of Ratification of the Equal Rights Amendment
The Equal Rights Amendment was first proposed 100 years ago in 1923. It's not clear that ratifying the ERA would mean restrictions on abortion have to be subject to intermediate scrutiny or outright prohibited, says CNN legal analyst Leah Pileggi. The justices would ask whether distinctions on the basis of gender identity are distinctions or discrimination on the based of sex," she adds.
