You don't want a dumb accountant or lawyer to torpedo you buying in. So what you would do is create an llc, and you would inject your retirement account money as a forty % owner. And the the current ownerw would buy or contribute the assets of the business through his escort as a 60% oner. You just need a good account and some lawyers to bring iu together it's no terribly expensive.
