The Voting Rights Act Is a Textualist, Right?
Elena Kagan is a textualist now. Like she's a textualist, too. They look to the text of the statute to solve the problem ahead of them. She looked and said, hey, look, Alabama, the text says your math is racist. So there, bang, bang, boom. Then this was beautiful. And then she went on to go on to basically throw shade at the Supreme Court by talking about how the Voting Rights Act has fared so poorly in recent years.
