The Relevance of the Contractor's Email
We establish that the email is relevant to show that the woman knew the deck railing needed repair. But we would also need to determine whether the email is hearsay. Here, the email is not hearsay because the contractor's statement is not being used for its truth. Does not need to be true for the woman to be on notice that the railing needs repair. The other use of this statement has completely different hearsay implications.
