The Justices' Approach to the Death Penalty
There were no less than three different ways that the justices approached this case, which involves a person sentenced to die. There seemed to be some willingness to question the sincerity of mister romer's religious beliefs. Some justices were extremely concerned about whether recognizing this religious liberty claim might invite other religious liberty claims down the road. And then finally, there seem to be this striking consensus among the justices that the death penalty is a fraught circumstance.
